Mr. Basobraj Chakraborty Mr. Subhajit Das Mr. Satyaki Choudhury …for the petitioners This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Senior Division), 1st Court, Contai, Purba Medinipur to dispose of the Title Suit No. 125 of 2026, expeditiously. The learned advocate for the petitioner submits that several interlocutory applications – one under Order 7 Rule 11 of the Code of Civil Procedure filed by the defendants/opposite parties and the application under Order 31 Rule 1 & 2 of the Code of Civil Procedure filed by the petitioners are pending. He further submits that the application under Order 7 Rule 11 of the Code of Civil Procedure is fixed for hearing on September 3, 2026. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite parties. However the learned Advocate-on-Record for the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submission made by the learned Advocate for the petitioners, this civil revisional application stands disposed of by requesting the learned Civil Judge 2 (Senior Division), 1st Court, Contai, to take up the hearing of the application under Order 7 Rule 11 of the Code of the Civil Procedure on the next date fixed i.e. 3rd September, 2026, if the same is otherwise ready for hearing and shall make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties. The learned trial judge is also requested to make an endeavour to dispose of the application under Order 39 Rule 1 & 2 of the Code as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
