Learned advocate for the petitioners submits that one of the accused persons has been granted bail, as such, the present petitioners may be released on bail. The petitioners are in custody for 11 months 22 days and witness action till date has not commenced, as such, there is no need to detain the petitioners in custody. Learned advocate for the State opposes the prayer for bail and submits that the recovery was made from the three petitioners. I have taken into account the quantum of seizure in the present case and I am of the opinion that the present petitioners do not stand on the same footing as the other
2 accused person who has been granted bail. Moreover, the rigors of Section 37 of the NDPS Act are attracted in the present case. Having considered the same, I am not inclined to release the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (NDPS) 1743 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
