Heard Ms.Ankita Gourha, learned counsel for the appellant as well as Mr.Priyank Rathi, learned Government Advocate appearing for respondents No.1 and 2/State. 2. The writ appeal has been filed by the appellant with the following prayers:- “(i) Allow the present Writ Appeal; (ii) Set aside the order dated 23.03.2026 passed by the learned Single Judge in Writ Petition (S) No. 5953 of 2017; (iii) Hold that the learned Single Judge ought to have adjudicated the controversy on merits instead of relegating the appellant to submit a representation before the respondent authorities; (iv) Remand the matter back to the learned Single Judge for fresh consideration and decision of Writ Petition (S) No. 5953 of 2017 on merits after considering the pleadings, documents and statutory provisions relied upon by the appellant; OR IN THE ALTERNATIVE (iv-a) Exercise appellate jurisdiction and adjudicate the controversy on merits by quashing the impugned order dated 16.08.2017 whereby the promotion of the appellant to the post of Joint Registrar was cancelled pursuant to the Review Departmental Promotion 3 Committee dated 02.05.2017; (v) Declare that the appellant was duly eligible for consideration and promotion to the post of Joint Registrar in accordance with Rule 13 and Rule 14 of the Chhattisgarh Cooperative Services Recruitment Rules, 1965 read with Rule 6 of the Chhattisgarh Civil Services (Promotion) Rules, 2003; (vi) Direct the respondents to treat the promotion of the appellant to the post of Joint Registrar vide order dated 19.05.2015 as valid and subsisting for all service purposes, including seniority, continuity of service and all consequential benefits; (viii) Pass any other order or direction which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case, including award of costs in favour of the appellant.” 3. Learned counsel for the appellant prays for withdrawal of the writ appeal. 4. Accordingly, the writ appeal is dismissed as withdrawn. 5. All the pending applications, if any, stand disposed of.
