JUSTICE H.T. NARENDRA PRASAD ORAL ORDER In this writ petition, the petitioner has sought for a direction to the FDP Court to dispose of the FDP No.174/2022 as expeditiously as possible. 2. Respondent herein is the plaintiff in O.S.No.4508/2016 on the file of the XVIII Addl. City Civil and Sessions Judge, Bengaluru (CCH-10) seeking partition and separate possession of the suit schedule property. A preliminary decree in the suit was passed on 30.10.2021. 3. Thereafter, the petitioner initiated final decree proceedings (FDP) in FDP No.174/2022 before the Court of Principal City Civil & Sessions Judge, Bangalore (for short, the ‘FDP Court’). In the meantime, the legal representatives of deceased defendant No.1 filed Regular First Appeal No.808/2023, which came to be dismissed on 17.07.2025, thereby confirming the preliminary decree. - 3 - HC-KAR NC: 2026:KHC:18628 WP No. 10300 of 2026 4. The FDP Court has now appointed a Court Commissioner. Therefore, learned counsel appearing for the petitioner prays for a direction for the expeditious disposal of the final decree proceedings. 5. In this regard, the learned counsel appearing for the respondent has submitted that he has no objection to the same. 6. In view of the above, without expressing any opinion on the merits of the case, the FDP Court is directed to dispose of FDP No.174/2022 as expeditiously as possible, within four months from the date of receipt of copy of this order in accordance with law, if no stay is granted by any other Court of law. 7.
