Singh, Advocate ----- Order No.02/Dated: 25th March, 2026 1. The present application has been filed under sections 483 and 484 of BNSS, 2023 for consideration of regular bail. 2. It is submitted by the learned senior counsel appearing on behalf of the petitioner that earlier prayer for bail of the petitioner was allowed vide order dated 29.7.2024 passed in BA No. 2299 of 2024 and he was released on bail. Thereafter the informant had challenged the said order before the Hon’ble Apex Court by filing SLP (Crl.) No. 14309 of 2024 seeking cancellation of bail and the Hon’ble Apex Court vide order dated 20.2.2025 pleased to set aside the order passed by this court and remanded the matter for reconsideration. Thereafter, vide order dated 12.8.2025 the bail application of the petitioner was rejected. Thereafter, the petitioner had voluntarily surrendered before the learned court below and since 20.3.2025 he is in custody. 3. It is further submitted that out of twelve charge-sheeted witnesses, six witnesses have been examined but the remaining witnesses are not being produced by the prosecution for their examination, including the informant. 4. Mr. Jitendra Shankar Singh, the learned counsel representing the informant in this case has submitted that the moment summons will be received by the informant he will appear to adduce his evidence in the trial. 5. In view of above submissions advanced on behalf of the informant, Mr. A.K. Kashyap, the learned senior counsel has submitted that he may be permitted to withdraw the present bail application as he does not want to press the same. 6. Prayer is accorded. 7. The present bail application is dismissed as not pressed and, as such, disposed of. 8. The learned court below is directed to look into the matter for issuance of summons as out of twelve charge-sheeted witnesses, six witness have already been examined in this case.
