This is an application filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in respect of S. C. Case No.173/2017, under Section 24/25/40/41 of the Assam Forest Regulation Act, 1891, read with Section 9/51 of Wild Life (Protection) Act, 1972, pending in the Court of the learned Additional District and Sessions Judge, Diphu, Karbi Anglong. Page No.# 2/2 3. The petitioner Amit Biswas was not present in the Court below therefore; the Court directed issue of Non-bailable warrant of arrest as well as P&A against the him 4. The petitioner submits that he went outside the state in search of livelihood. The petitioner submits that he is interested in facing the trial and therefore he deserves to be given adequate opportunity to that effect. 5. I have considered the submissions made by the learned counsel for both sides. 6. Since the petitioner is interested in facing the trial, he deserves to be given adequate opportunity to that effect. 7. Therefore, all orders directing issue of non-bailable warrant of arrest as well as P&A against the present petitioner Amit Biswas by the learned Additional District and Sessions Judge, Diphu, Karbi Anglong are set aside. 8. The petitioner is directed to appear before the Trial Court in respect of Sessions Case No.173/2017 within a period of 7 (seven) days from today and on his appearance, the petitioner shall be released on fresh bail of Rs.25,000/- with a surety of like amount to the satisfaction of the learned Additional District and Sessions Judge, Diphu, Karbi Anglong. 9.
