VIJAY KUMAR BIDHURI ...Respondent(s) Through: Mr. Shahbaz Sikander Mir, AAG
CORAM:
HON’BLE MR. JUSTICE WASIM SADIQ NARGAL, JUDGE
ORDER 19.09.2026
1. The instant contempt petition has been filed alleging non- compliance of the order dated 11th November, 2022 passed by the learned Single Judge, whereby the writ petition preferred by the petitioner was disposed of at the threshold with a direction to the respondents to consider the representation stated to have been filed by the petitioner on 01.11.2022, in accordance with law/rules, and take a decision thereon within a reasonable timeframe, preferably within a period of two months from the date a certified copy of the order along with the complete paper book was served upon the respondents. Till a decision in the matter was taken, the respondents were also directed to maintain status quo with respect to the subject matter of the writ petition.
2. It is alleged that the aforesaid order has not been complied with, which constrained the petitioner to file the instant contempt petition. Notice was issued to the respondents, who were granted a last and final opportunity to file the compliance report vide order dated 7th August, 2025. However, the compliance report has not been filed till date. Despite another
opportunity having been granted vide order dated 7th August, 2026, the position remains unchanged.
3. Today, when the instant contempt petition was taken up, Mr. Shabaz Sikandar,
learned counsel appearing for the respondent assures this Court that the order passed by this Court shall be complied with within a period of two weeks from today.
4. In view of the statement so made and the assurance extended on behalf of the respondents, this Court is of the view that no fruitful purpose would be served in keeping the instant contempt petition pending. Accordingly, the instant contempt petition is disposed of with a direction to the respondents to comply with the order dated 11th November, 2022 passed by this Court within a period of two weeks from today.
5. It is, however, made clear that in the event the aforesaid order is not complied with within the stipulated period of two weeks, the petitioner shall be at liberty to seek revival of the instant contempt petition. In such an eventuality, the Court shall be at liberty to take appropriate coercive measures against the respondents, in accordance with law.
6. In view of the disposal of the contempt petition, the rule, if any framed, shall stand discharged.
