Bhattacharya, learned counsel for the petitioner and Mr. R.J. Baruah, learned Addl. Public Prosecutor, Assam for the State respondent. 2. This bail application has been filed by the petitioner namely, Parameswar Boro under Section 483 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, seeking bail in connection with Dimakuchi P.S. Case No. 71/2025 under Page No.# 2/3 Sections 20(b)(ii)(c)/ 25/29 of the NDPS Act. 3. The allegation against the petitioner is that as per the FIR in Dimakujchi P.S. Case No. 71/2025 which was registered under Sections Sections 20(b)(ii) (c)/ 25/29 of the NDPS Ac, on 12.12.2025 at about 10.00 a.m. one information was received from reliable source by the O.C. Dimakuchi P.S. that two persons were travelling in a white colour Maruti Suzuki Spresso vehicle bearing registration No. AS-25 Q 7208, carrying huge quantity of narcotic drugs Ganja (Cannabis) from Udalguri to Tamulpur side and as such one G.E. Entry was made vide Dimakuchi P.S. GDE No. 13 dated 12.12.2025 and thereafter naka checking was put up and at about 10.30 a.m. Sri Jibendra Brahma OC of Tangla P.S. reached at checking point and after sometime, the informant noticed the said vehicle coming towards the naka checking from Udalguri side and when the team signaled the car to stop the driver rashly drive the vehicle and fled the naka point and after a chase the accused in the car left the vehicle and fled away and thereafter on checking the vehicle the police seized 62.775 kgs of suspected ganja (cannabis) contained in 12 packets and hence the FIR was registered. 4. The police visited the house of the petitioner on 19.01.2026 and arrested him and he was remanded to judicial custody after 2 days of police remand. 5. The case diary as called for has been received and perused. 6. The learned counsel for the petitioner has submitted that nothing was recovered from the possession of the present petitioner and he was arrested merely on suspicion and also on the basis of some alleged phone calls between the petitioner and the co-accused, Samiran Talukdar. 7. On the other hand, the learned Addl. Public Prosecutor has submitted on Page No.# 3/3 the basis of the materials available in the case diary that the present petitioner had supplied 60 kgs of ganja to co-accused, Samiran Talukdar and loaded the same on the vehice of the said co-accused and also escorted him on his motor vehicle from Roata via U.T. Road towards Tamulpur but on encountering naka checking at Dimakuchi, the present petitioner fled on his vehicle while co- accused Samiran Talukdar and his associates escaped into the jungle. There are sufficient materials against the petitioners collected by the I.O. Therefore, he opposes the prayer for bail. 8. It also appears from the case diary and the records that on the date of occurrence, the petitioner was in constant touch over phone with the main accused at the time of transportation of the contraband and furthermore, their location is also same. 9. In view of the above incriminating materials in the case diary as well as the fact that the contraband seized amounts to commercial quantity and having regard to the provisions of Section 37 of the NDPS Act, the prayer for bail is rejected at this stage. 10.
