It has been pointed out that Ms. Ashmita Chakraborty, learned advocate represented the State but her names were not recorded in the order dated 28th November, 2025. It is recorded that Ms. Ashmita Chakraborty, learned advocate represented the State on 28th November, 2025. The petitioners have sought for a direction upon the Block Land and Land Reforms Officer to demarcate the raiyati property of the petitioners and the private respondents. On a query of the Court the learned advocate appearing for the petitioners could not cite any provision of any statute which permits the Block Land and Land Reform Officer to resolve a boundary dispute between two private parties by demarcating the immovable property of private parties. That apart a civil suit between the petitioners and the private respondents is also pending.
2 For the aforesaid reasons this Court is not inclined to pass any direction upon BL & LRO to demarcate the raiyati properties of private parties. It will be open to the petitioners to pray for necessary order in the civil suit in accordance with law. With the above observations, WPA 26912 of 2025 stands disposed of. There shall be however no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
