Pursuant to the earlier order dated 07.08.2026 the Officer- in-Charge of Patiram Police Station, Mr. Satkar Syangbo, is present in Court. The Superintendent of Police, Dakshin Dinajpur will issue a notice to assess whether a disciplinary proceeding should be initiated in view of the nature of recording in the Case Diary so far as the availability of videography is concerned and the same being practically absent physically. So far as the merits of the case are concerned, petitioner is in custody for one year six months. Two of the independent witnesses have turned hostile. The photographer’s evidence is also complete. Without further entering into the merits of the case, I am of the opinion that some elements of Section 37 of the NDPS Act has been diluted, as such the petitioner be released on bail.
2 Accordingly, the petitioner, namely, Alok Mondal shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court (under NDPS Act), 3rd Court, Balurghat, Dakshin Dinajpur. If on bail, the petitioner shall be physically present on each and every date before the learned Court and shall not leave the jurisdiction of district of Dakshin Dinajpur without prior permission of the learned Special Court. Thus, CRM (M) No. 1527 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
