Mr. Nirmalendu Bera Ms. Gopa Das ..for the petitioners This application under Article 227 of the Constitution of India is at the instance of the plaintiffs and is directed against an order being no.45 dated 10th July, 2026 passed by the learned Civil Judge (Junior Division), 3rd Court at Diamond Harbour, 24 Parganas (South) in Title Suit No. 81 of 2023. By the order impugned the application under Order 1 Rule 10 of the Code of Civil Procedure filed by the petitioners stood rejected. The learned advocate appearing for the petitioners submits that the instant application for addition of party was filed as the persons who have been named in the said application are creating disturbances in the possession of the petitioners in respect of the suit property. After going through the averments made in the said application this Court finds that the petitioners have not stated as to how the persons who have been sought to be added are necessary parties for the purpose of deciding the dispute involved in the suit. Thus, the learned trial judge was right in holding that the petitioners have failed 2 to satisfy that the persons named in the petition are necessary parties for the suit or their presence is necessary to enable the court decide the disputes involved in the suit effectively. For such reason, this Court is not inclined to interfere with the order impugned. Accordingly, C.O. 2620 of 2026 stands disposed of. There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities. (Hiranmay Bhattacharyya, J.)
