1. Learned Counsel appearing on behalf of the petitioners submits that the petitioners are innocent. This case is based on a counterblast. The disputes between the parties are with regard to a property dispute. The de facto complainant is the promoter and the present petitioners are the husband and friends of the landlady, who actually suffered injury. Both the cases were registered under the same sections. The victim lady suffered grievous injuries. The lady was granted anticipatory bail by the Sessions Court in the present case. 2. Learned Counsel appearing on behalf of the petitioners submits anticipatory bail may be allowed on any terms and conditions. 3. Learned Advocate appearing for the State opposes the prayer for anticipatory bail and produces the Memo of Evidence and Case Diary. 2
4. Let the Memo of Evidence be taken on record. 5. Having heard the submission of the respective parties and upon consideration of the materials particularly the nature of the injury and the charge-sheet having already been submitted, this Court is of the opinion that custodial detention of the petitioners is not necessary. 6. As such, the prayer for anticipatory bail of the petitioners, namely, SRI PRAMOD KUMAR DUBEY, SRI DIPAK DEY and SRI SUJAY HALDAR is allowed. 7. Accordingly, in the event of arrest, the petitioners shall be released on bail to the satisfaction of arresting officer on the terms and condition as he deems fit and proper and also subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita,
2023. 8. In the event, the petitioners fail to comply with any of the conditions as imposed by this Court, the prosecution shall be at liberty to pray for cancellation of the anticipatory bail granted by this Court in accordance with law. 9.
The application for anticipatory bail being CRM(A) 1964 of 2026 is, thus, allowed. 10. All concerned parties shall act on the server copies of this order duly downloaded from the official website of this Court. 11. Criminal Section is directed to supply urgent certified copies of this order to the parties, if applied for, upon compliance of all necessary formalities. (Ajay Kumar Gupta, J.)
