In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Entally Police Station Case No. 112 of 2025 dated 05.05.2025 under sections 61(2)/310(2)/311 of the Indian Penal Code, 1860.
And In the matter of : Mintu Sarkar
……Petitioner.
Mr. Jayanta Narayan Chatterjee, Sr. Adv.
Ms. Jayashree Patra
……for the Petitioner.
Mr. L. Vishal Kumar
Mr. Sanjib Das
….for the State.
Learned advocate appearing for the petitioner submits that petitioner is in custody for 1 year and 3 months and till date out of the 54 witnesses only the evidence of the first witness is in progress.
Learned advocate for the State opposes the prayer for bail and submits, petitioner is a police constable of the Special Task Force who was associated with the offence. He is the master mind in the alleged commission of offence. The offence was committed at the heart of the city and a sum of Rs. 2 Crores were robbed from the employee of Forex Company who was plying in a taxi after forcefully boarding the taxi, taking
2 them to the nearest destination towards the railway tracks and thereafter fleeing away with cartons of money on the other side of the railway tracks. Police authorities had to put in efforts for investigating and unearthing the truth. Subsequently, the complicity of the present petitioner surfaced.
Having regard to the complicity of the present petitioner is, as a master mind who instructed his relevant sources for committing the offence, I am of the opinion this is not a fit case for granting bail.
Accordingly, CRM (M) 1229 of 2026 is dismissed.
