JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question the proceedings in CC No.179 of 2024 registered for the offences punishable under Sections 504, 506, 323, 498A, 149 of the IPC and under Sections 3 and 4 of DP Act. 2. Heard Sri B J Hitesh Gowda, learned counsel appearing for the petitioner, Smt Deepthi Alva, learned High Court Government Pleader appearing for respondent No.1, - 3 - HC-KAR CNR: KAHC010367332024 NC: 2026:KHC:41934 CRL.P No. 6865 of 2024 Sri M N Ningaraja, learned counsel appearing for respondent No.2 and have perused the material on record. 3. The parties to the lis were also before the Family Court in MC No.153 of 2023 and have settled the dispute amongst themselves before the Family Court by terms of settlement. One of the term of the settlement is, closure of the present proceedings. The said term in the settlement reads as follows: "MEMO REPORTING SETTLEMENT WITH RESPONDENT NO.2 IN MC NO.153/2023 The undersigned counsel for the Petitioner submits that: 1. The Petitioner submits that, the Petitioner has filed the present criminal petition seeking for quashing of the entire proceedings against the Petitioner in CC No.0179/2024 pending at the file of the III Addi. Civil Judge (Jr.Dn.) And JMFC Court, Channarayapatna, Hassan District, for the offences punishable under Sec.504, 506, 323, 498A, 149 of IPC, 1860 & Sec. 3, 4 of D.P. ACT. 2. The Petitioner submits that, the Petitioner and the Respondent No.2 have filed compromise application before the Addl. Senior Civil Judge & JMFC at Channarayapatana in MC No.153/2023. The Ld. Trial Court accepted the compromise entered between the Petitioner and Respondent No.2 and dissolved the marriage in accordance with the terms of the compromise entered between the parties. The Certified Copy of the Ordersheet dated 06.02.2026 in MC No.153/2023 is enclosed as Document No.1. - 4 - HC-KAR CNR: KAHC010367332024 NC: 2026:KHC:41934 CRL.P No. 6865 of 2024 The Certified Copy of the Decree dated 06.02.2026 in MC No.153/2023 is enclosed as Document No.2. 3. The Petitioner submits that, the Respondent No.2 as per the compromise dated 06.02.2026 had agreed to withdraw CC No 0179/2024 pending at the file of the III Addi. Civil Judge (Jr.Dn.) and JMFC Court, Channarayapatna. However, the Respondent No.2 is not co-operating with the Petitioner to report settlement in the said matter. The Respondent No.2 had also agreed to withdraw CrlMisc No.41/2024, CC No.722/2023, CC No.464/2023 and CC No.3662/2023 filed by the Respondent No.2 against the Petitioner and his family members. The same has been recorded in Para-2 of the Compromise dated 06.02.2026 and the ordersheet in MC No.153/2023 and the decree has also been drawn accordingly. The Certified Copy of the Compromise dated 06.02.2026 in MC No. 153/2023 is enclosed as Document No.3. 4. The Petitioner submits that, despite the compromise entered by the Respondent No.2 and having receive the alimony in open court as full and final settlement, the Respondent No.2 for the best known reasons is not co-operating with the Petitioner to withdraw the matters as agreed in MC No. 153/2023 even after 6 months after the said compromise. Wherefore, the Petitioner humbly prays this Hon'ble Court may be pleased to allow the Criminal Petition and quash the entire proceedings against the Petitioner in CC No.0179/2024 pending at the file of the III Addl. Civil Judge (Jr.Dn.) And JMFC Court, Channarayapatna, Hassan District, for the offences punishable under Sec.504, 506, 323, 498A, 149 of IPC, 1860 & Sec.3, 4 of D.P. ACT in the interest of justice.
