In this petition, the petitioner is assailing the order dated 28.04.2026 (Annexure-G) passed by respondent No.2 and the endorsement dated 18.06.2026 (Annexure-H) passed by respondent No.3, in respect of the subject matter. - 3 - HC-KAR CNR: KAHC010480942026 NC: 2026:KHC:39816 WP No. 21927 of 2026 3. Having heard the learned counsel appearing for the parties and on careful consideration of the impugned endorsement at Annexure-H would indicate that respondent No.3 ought not to have issued such an endorsement to the appellant therein being aggrieved by the order passed by respondent No.2. 4. In that view of the matter, it is the duty of respondent No.3 to consider the appeal preferred by the petitioner herein under Section 136(2) of the Karnataka Land Revenue Act, 1964 and to follow the relevant rules as to issue the notice to the other side and thereafter take decision in the matter after considering the original documents on record. In that view of the matter, I find force in the submission made by the learned counsel appearing for petitioner. Hence, I pass the following: ORDER (i) The Writ Petition is allowed. (ii) Endorsement dated 18.06.2026 (Annexure-H) passed by the respondent No.3 accordingly is set aside. - 4 - HC-KAR CNR: KAHC010480942026 NC: 2026:KHC:39816 WP No. 21927 of 2026 (iii) The matter is remitted to respondent No.3 to re-hear the appeal filed by the petitioner herein, in terms of the observation made above and take decision in the matter in accordance with law. (iv) While considering the appeal it is the duty of respondent No.3 to afford opportunity of hearing all the parties concerned and take decision in the matter.
