Rakib CRM (A) 1791 of 2026 In Re: An Application for Anticipatory Bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with English Bazar Police Station case no. 511 of 2026 dated 06.04.2026 under Sections 108/3(5) of the Bharatiya Nyaya Sanhita, 2023. And In the matter of : Rinku Tewary @ Rinku Tewari & Anr. ……Petitioners. Mr. Md. Wasim Akram .....for the Petitioners. Mr. Anurag Sardar ……for the State. Learned advocate appearing for the petitioners submit that the accusations are delayed and do not create any foundational facts. Additionally, it has been submitted that there was a relationship. However, because of girl being minor the families were not ready to accept the relationship. Learned advocate appearing for the State opposes the prayer for anticipatory bail and draws the attention of the Court to the relevant statement of witnesses including the complaint. The accusations, prima facie, reflect that the deceased was assaulted with shoe in the market in front of the people at large. Having considered the same, I am of the opinion that this is not a fit case for granting anticipatory bail to the present petitioners. As such, the prayer for anticipatory bail of the petitioners in CRM (A) 1791 of 2026 is rejected. 2 Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
