Kausik (Allowed) CRM (A) 2727 of 2026 In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973/Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kotshila Police Station Case No. 20 of 2026 dated 31.03.2026 under Sections 85/80/103(1)/3(5) of the BNS, 2023. And In the matter of : Saddam Ansari @ Saddam Ansary & Anr. ……Petitioner. Mr. Sumanta Chakraborty Mr. Sukhendu Bikash Mukherjee Ms. Tanisha Barua ……for the Petitioner. Mr. Krishnendu Bhttacharya, APP Ms. Priti Kar Bagchi ….for the State. Learned advocate appearing for the petitioner submits that petitioner no. 1 is the brother-in-law and the petitioner no. 2 is the mother-in-law of the deceased. Marriage was solemnized five years ago prior to the date of the incident. State has opposed the prayer for anticipatory bail. I have taken into account the post-mortem report along with the statement of the other witnesses. 2 Having considered that charge sheet has already been submitted and the opinion of the doctor being death due to anti-mortem hanging, I am inclined to allow the prayer for anticipatory bail of the present petitioners. As such, prayer for anticipatory bail is allowed. As such, I direct that in the event of arrest, the petitioner namely, (1) Saddam Ansari @ Saddam Ansary, (2) Akila Bibi be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As charge sheet has already been submitted, this order of anticipatory bail will remain in force for a period of 6 weeks from date. Accordingly, CRM (A) 2727 of 2026 is allowed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
