2. Mr. N.S. Kanyal, learned AGA and Mr. Dinesh Chauhan, learned AGA for the State.
3. Present bail application is moved by the applicant, who is in judicial custody, in connection with Case Crime No.31 of 2025 under Section 8/20 of Narcotic Drugs and Psychotropic Substances Act, P.S. Mori, District Uttarkashi.
4. According to the FIR on 04.11.2025 on the basis of the suspicion the police intercepted the applicant and on interrogation about the bag carried by him he did not given satisfactory answer. When the police searched the bag carried by the applicant, 1.12. kg. charas was recovered.

Learned counsel for the applicant submits that applicant has been falsely implicated in the present crime and there is no compliance of Section 50 of the NDPS Act. It is submitted that applicant is a patient of acute Tuberculosis and is undergoing medical treatment. He submits that applicant has no criminal history and is languishing in jail since 04.11.2025.
6. Learned State counsel has opposed the bail application and submits that the quantity which was recovered from the application is a commercial quantity and all the provisions of the NDPS Act have been followed thus the bail application of the applicant be rejected.
7. After hearing the learned counsel for the parties and considering the
facts and circumstances of the case, this Court is of the view that applicant be released on bail.
8. Accordingly, bail application is allowed. Let the applicant-Jai Singh Chauhan be released on bail on his executing a personal bond and two reliable sureties of the like amount to the satisfaction of the court concerned.
