Accused in Crime No.194/2026 registered by Soladevanahalli Police Station, Bengaluru City, for the offences punishable under Section 64(2)(m) of BNS, 2023, Section 66(E) of the Information Technology Act, 2000, Sections 4, 5(l) and 6 of the POCSO Act, 2012, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.194/2026 was registered by Soladevanahalli Police Station, Bengaluru City, for the aforesaid offences against the petitioner herein based on the first information dated 26.05.2026 received from the victim girl aged 17 years. In the said case, petitioner was arrested on 27.05.2025 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in - 3 - HC-KAR CNR: KAHC010450092026 NC: 2026:KHC:42266 CRL.P No. 9637 of 2026 Crl.Misc.No.1107/2026 was rejected on 27.06.2026. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that petitioner is aged 25 years and the victim girl is aged 17 years and they were acquainted to each other after they got introduced through Instagram app. The statement of the victim girl has been recorded in the present case under Section 183 of BNSS, 2023, on 05.06.2026 by the Court of jurisdictional Magistrate. Victim girl has stated that she had gone with the petitioner to various places and had stayed with him. She has also stated that after the alleged date of incident in which she had sexually intercourse with him, she had gone out with him and they also had spoken about their marriage. She has stated that subsequently there was a dispute with regard to their marriage and therefore, petitioner had abused her mother and also criminally intimidated her and under these circumstances, she had approached the police. - 4 - HC-KAR CNR: KAHC010450092026 NC: 2026:KHC:42266 CRL.P No. 9637 of 2026 5. Learned counsel appearing for respondent No.2, on instructions, submits that he has no objection to grant bail to the petitioner. 6. It is brought to the notice of this Court that investigation of the case is now completed and charge sheet is filed. Under the circumstances, the following order:- 7. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.194/2026 registered by Soladevanahalli Police Station, Bengaluru City, for the offences punishable under Section 64(2)(m) of BNS, 2023, Section 66(E) of the Information Technology Act, 2000, Sections 4, 5(l) and 6 of the POCSO Act, 2012, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the - 5 - HC-KAR CNR: KAHC010450092026 NC: 2026:KHC:42266 CRL.P No. 9637 of 2026 Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
