Applicants have filed this application under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short “BNSS”) for grant of anticipatory bail as they are apprehending their arrest in connection with Crime No.557 of 2026 registered at Digitally signed by PRAVEEN KUMAR SINHA Date: 2026.09.11 10:59:30 +0530

Case of the prosecution, in brief, is that complainant lodged report in the concerned police station alleging that applicants have made demand of Rs.4 lakh to provide government job in Women and Child Welfare Department on the post of Supervisor. Initially complainant paid Rs.50,000/- to applicant No.2-Sanjay Bose. However, when result came, name of complainant did not find place in the select list. Applicants have also taken Scorpio vehicle from uncle of complainant assuring that they will pay the amount towards Scorpio. However, neither the amount was paid nor the vehicle was returned. On the basis of complaint, aforementioned crime was registered. 3. Learned counsel for the applicants submits that, as per the allegation, only a sum of Rs.50,000/- was paid to the applicants, whereas the applicants, in total, have transferred to complainant a sum of Rs. 61,000/- through online transactions. Copy of screenshot of online transfer of money is placed on record. Allegation with regard to taking over possession of Scorpio vehicle for purchasing the same is falsely made as the uncle of complainant is in Police Department. This allegation is made only to make offence more grievous. There is no other criminal antecedent of applicants. Hence, they may be protected by granting benefit of anticipatory bail. -3-
4. On the other hand, learned counsel for the State opposes the submission of learned counsel for the applicants.
He submits that from the complainant available in the case diary it is reflecting that the applicants have procured Rs.50,000/- from the complainant on the assurance of providing him government job and as per agreement, complainant was to pay Rs.4 lakh to applicants. There is prima facie involvement of the applicants in commission of aforementioned offence. Hence, they are not entitled to grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the documents available on record. 6. Taking into consideration the facts and circumstances of the case, nature of allegations, applicants have no criminal antecedents, without expressing any opinion on the merits of the case, I am inclined to allow the present application. 7. Accordingly, application is allowed and it is directed that in the event of arrest of applicants in connection with the aforesaid crime, they shall be released on anticipatory bail by the Officer arresting them on each of them executing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned arresting officer. Applicants shall also abide by the following conditions :-
“(i) that the applicants shall remain available for
-4- interrogation before the Investigating Officer as and when required; (ii) the applicants shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;
