WP No. 13995 of 2026 For Petitioner(s): C.Prakasam For Respondent(s): ORDER This petition has been filed seeking a direction to the 1st respondent, namely Wakf Tribunal, to dispose the appeal filed by the 2nd respondent in O.A. No 43 of 2018 on merits, within a time frame to be fixed by this Court. 2.The learned counsel for the petitioner would submit that, the petitioner is in no way connected with Hazarath Peer Mohammed Sha Kadhiri Avulliah Durga, Thanjavur which is a notified Wakf Institution engaged in religious, charitable, and public welfare activities. However, the said Dargah has laid claim over the land situated in T.S No.1331, Puducpattinam, Thanjavur Taluk, Ward-6, Block-26. In this connection, the Dargah approached the Wakf Tribunal cum Principal Sub Court, Thanjavur, and filed a petition in W.O.P No.1 of 2017, seeking to restrain the petitioner from alienating the said property. The said Court referred the matter to the 1st respondent Tribunal, where it was renumbered as O.A No.43 of 2018, and the same is pending before the Wakf Tribunal at Chennai. WP No. 13995 of 2026 the property, due to the pendency of the case before the 1st respondent Tribunal for the past eight years, the petitioner has been unable to deal with the said land, which has directly affected his property rights, administration and the income derived from the land. Hence the present writ petition has been filed for the aforesaid relief.
3.Considering the limited request made by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the 1st respondent Wakf Tribunal to dispose the appeal filed by the 2nd respondent in O.A. No 43 of 2018, on merits and in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order, 4.With the above direction, this writ petition is disposed of.
