(ii) Issue any other relief, which this Hon’ble Court may deem fit and proper in the circumstances of the case be passed in favour of the petitioner. (iii) Cost of the petition be awarded in favour of the petitioner.” 2. Heard Mr. Tapan Singh, learned counsel for the petitioner and Mr. M.K. Ray, learned counsel for the respondent. 3. Mr. Surendra Kumar Sahgal, the Executive Engineer, Electricity Distribution Division and Mr. Rakesh Kumar Gupta, Power of Attorney Holder of the respondent Kamlesh are present in-person before this Court. Mr. Rakesh Kumar Gupta has received a cheque (Cheque No.28904) dated 23.02.2026 of Rs.5,00,556/- (Rupees five lakh five hundred fifty six) from Mr. Surendra Kumar Sahgal, the Executive Engineer, Electricity Distribution Division, Nainital. 5. Learned counsel for both the parties have requested to decide the present writ petition in terms and conditions of the settlement, recorded by the mediator in Mediation Case No.48 of 2026, “Executive Engineer, Electricity Distribution Division vs. Kamlesh”. 6.
