The present Writ Petition has been filed under Article 227 of the Constitution of India with the following prayers:- “(i) Issue a writ, order or direction in the nature of certiorari, quashing the impugned judgment dated 28.04.2023 passed by learned CGRF Haldwani, District Nainial (Annexure No.13 to this Writ Petition). (ii) Issue any other relief, which this Hon’ble Court may deem fit and proper in the circumstances of the case be passed in favour of the petitioner. (iii) Cost of the petition be awarded in favour of the petitioner.” 2. Heard Mr. Tapan Singh, learned counsel for the petitioner and Mr. M.K. Ray, learned counsel for the respondent. 3. Learned counsel for both the parties submitted that the present matter was referred for mediation. The disputes have been settled before the Mediator Shruti Joshi, Advocate. 1 2026:UHC:1170 4. Mr. Surendra Kumar Sahgal, the Executive Engineer, Electricity Distribution Division and Mr. Rakesh Kumar Gupta, Power of Attorney Holder of the respondent Kamlesh are present in-person before this Court. Mr. Rakesh Kumar Gupta has received a cheque (Cheque No.28904) dated 23.02.2026 of Rs.5,00,556/- (Rupees five lakh five hundred fifty six) from Mr. Surendra Kumar Sahgal, the Executive Engineer, Electricity Distribution Division, Nainital. 5. Learned counsel for both the parties have requested to decide the present writ petition in terms and conditions of the settlement, recorded by the mediator in Mediation Case No.48 of 2026, “Executive Engineer, Electricity Distribution Division vs. Kamlesh”. 6. The present writ petition is decided in terms and conditions of the Settlement, recorded by the mediator on 13.02.2026.The report of the Mediator dated 13.02.2026 shall form part of this order. ___________________ ALOK KUMAR VERMA, J.
