1. Let affidavit-of-service, as filed in Court, be kept on record.
2. The petitioner is aggrieved that her application for appointment as an Accredited Social Health Activist (ASHA) has not been considered in spite of the fact that she is eligible.
3. In fact, her representation made sometime in June, 2026 has also not been considered.
4. The petitioner is aggrieved that the private respondent, not being so entitled and eligible, has been appointed as an ASHA worker.
5. Mr. Dutta, learned Advocate appearing for the private respondent, submits that the allegations levelled against his clients are all false as he is
2 entitled and eligible having a place of residence within the zone for which the selection has been done.
6. In view of the aforestated, respondent no. 3 is
directed to consider the writ petition of the petitioner as a representation and upon hearing the petitioner will pass a reasoned order within a period of four weeks from the date of communication of this order.
7. The order to be passed by the respondent no. 3 should not, in any manner, impede the rights of the private respondent or her appointment as an ASHA worker. If such an issue is to be decided, she will be given adequate prior notice to attend the hearing.
8. In view of the aforestated, the writ petition is
disposed of.
9. Since no affidavit has been called for, all the allegations leveled against the petitioner are deemed to have been denied.
10. There will be no order as to costs.
11. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
