These applications arise out of the same Crime No. 114 of 2025, therefore, both applications were heard together and are being decided by this common order. 2. The applicants have preferred this First Bail Application under Section 483 VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2026.09.10 14:47:22 +0530 2 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as they have been arrested in connection with Crime No. 114/2025, registered at Police Station : Balrampur District Balrampur - Ramanujganj (C.G.) for the offence punishable under Sections 20(B)(II)(c), 27(a) & 29 of the NDPS Act and Section 61(2) of the BNS. 3. Case of the prosecution, in brief, is that, on receiving information that a tractor had met with an accident in a hilly area and that articles suspected to be ganja were scattered near the tractor, police reached at the spot and found 89 packets lying around the tractor-trolley. The said packets were seized and, upon examination, were found to contain ganja weighing 125.51 kilograms. The injured driver of the tractor was found lying near the spot and, upon interrogation, his memorandum statement was recorded, wherein he stated that the seized ganja belonged to Gyanchand Paswan and that the tractor and trolley belonged to Ranjan Shrivastava. He further stated that Ranjan Shrivastava, the owner of the tractor, was following the tractor in his Brezza car. On the basis of the memorandum statement, the present applicants were also made accused in the case and were arrested on 27.08.2025. 4. Learned counsel for the applicants submits that the applicants are innocent and have been falsely implicated in the present crime. He further submits that the applicants were neither found present at the spot nor arrested from the spot. It is further submitted that the applicants have been implicated in the present case only on the basis of the memorandum statement, and there is no other material connecting them with the commission of the alleged offence. Learned counsel further submits that it is not in dispute that Ranjan Shrivastava, the applicant in MCRC No. 8233 of 2026, is the registered owner of the tractor-trolley in question. Therefore, the applicants deserve to be enlarged on bail. 3 5. Learned State counsel opposes the submissions advanced on behalf of the applicants and submits that, from the material available in the charge-sheet, it is apparent that the applicants are involved in organized crime relating to the transportation of the contraband ‘ganja’ in the tractor-trolley. He further submits that the bail application of co-accused Gajendra Kumar Singh was rejected by the Co-ordinate Bench of this Court vide order dated 08.07.2026 passed in MCRC No. 5945 of 2026. He also submits that the applicants are residents of Bihar and, therefore, they are not entitled to the grant of regular bail. 6. I have heard learned counsel for the respective parties and perused the documents filed along with the bail application. 7. Taking into consideration the facts and circumstances of the case, the nature of the allegations, the submissions advanced by learned counsel for the respective parties, the documents enclosed along with the bail applications, and the quantity of the contraband ‘ganja’ seized, I do not find the present cases to be fit cases for grant of bail. 8. Accordingly, the bail applications filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 are dismissed. Certified copy as per rules. Sd/- (Parth Prateem Sahu) Judge Vaibhav
