CRM-M-9272-2026 -1- 314 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH CRM-M-9272-2026 Date of Decision:- 23.03.2026 PARVEEN KUMARI ....Petitioner Vs. STATE OF PUNJAB ...Respondent CORAM:- HON'BLE MRS. JUSTICE AMARJOT BHATTI Ms. Manjot Kaur, AAG, Punjab. AMARJOT BHATTI, J. 1. Petitioner Parveen Kumari has filed instant petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail in FIR No.40 dated 08.05.2025 under Sections 76, 115 (2), 351 (2), 3 (5) of Bharatiya Nyaya Sanhita, 2023 registered at Police Station Shahpur Kandi, Pathankot. 2. As per facts of the case, complainant Meena Kumari gave her statement that on 03.05.2025 at about 8.30 am, she was walking outside her house which is vacant plot. Ganesh Dutt, Ramesh, Roop, Bishan, Ashwani and Mehar were standing there. Ganesh Dutt raised a lalkara to teach her a lesson who considered her a senior lawyer. He caught hold of her and Ramesh snatched her phone. Roop pulled her duppata whereas Bishan pulled her hairs She tried to escape. Ganesh Dutt humiliated her and had torn her shirt from the shoulder and touched her in an inappropriate SANDEEP KUMAR 2026.03.25 14:37 I attest to the accuracy and integrity of this document CRM-M-9272-2026 -2- manner. She came home. At about 9 am, Ganesh Dutt holding a sickle, Ashwani holding iron chain, Mehar, Parveen Kumari, Rani, Kausalya and Pushpa holding sickles in their hands came there. Roop was holding a bat in his hand and Bishan was holding a hockey stick in his hand. They break open the gate of their house and climbed on the wall. They came inside the house. Ashwani caught hold of her and threw her on the ground. Mehar, Roop Lal and Parveen caught hold of her legs. Ganesh Dutt slapped on her face. Ramesh opened her salwar. On hearing her screams, her mother Nirmala Devi and brother Ashwani came forward to rescue her. Aforesaid persons gave beating to them. Ganesh Dutt gave sickle blow from its backside which hit on the right arm of Ashwani. Ramesh gave stick blow which hit on his right wrist. Roop Lal gave bat blow towards her mother. Ganesh Dutt and Parveen Kumari pulled her mother’s hairs and dragged her. They break open the main gate, flower pots, window and side of the wall. The reason behind this occurrence was dispute regarding plot of 5.06 marla bearing khasra No.232 (13-11) which is in their legal possession. Said persons wanted to take forcible possession of their land. With these allegations, present FIR has been registered. 3. Learned counsel representing petitioner argued that false allegations are levelled against her and other co-accused on account of dispute over the ownership of plot. During investigation vide GD No.28 dated 25.05.2025, it was found that no offence was made out under Sections 333, 324 (4), 190 and 191 (3) of Bharatiya Nyaya Sanhita, 2023. Co-accused Rani Devi in CRM-M-57879-2025 !has already been granted bail by this Court vide order dated 05.02.2026. She is ready to join SANDEEP KUMAR 2026.03.25 14:37 I attest to the accuracy and integrity of this document CRM-M-9272-2026 -3- the investigation. Allegations qua her are false and general in nature. She will abide by the terms of bail order. 4. Bail petition is opposed by learned counsel representing State of Punjab assisted by learned counsel representing the complainant. It is pointed out that petitioner along with other co-accused is named in the FIR. Complainant and her family members were attacked by going to their house. As per status report, dispute is regarding a plot where Meena Kumari was carrying construction using a JCB and on that account scuffle took place. Therefore, anticipatory bail petition filed by petitioner is opposed. 5. I have considered the arguments. Even as per contents of the FIR and status report, it is clear that dispute is between the parties regarding a plot. It is claimed that she alongwith other co-accused entered the house of complainant holding sickle. Role attributed to the present petitioner regarding second incident is that she caught hold of the legs of prosecutrix whereas Ganesh Dutt slapped her, then there are allegations against Ramesh for outraging the modesty of prosecutrix. As referred above, during investigation as per GD No.28 dated 25.05.2025 no offence was made out under the provisions of Section 333, 324 (4), 190 and 191 (3) of BNS. Present petitioner is ready to join the investigation. Without expressing my mind on the merits of the case and considering the aforesaid facts, anticipatory bail petition filed by petitioner is allowed. She be not arrested. In case of her arrest, she be released on bail to the satisfaction of Arresting/Investigating Officer concerned, subject to condition that SANDEEP KUMAR 2026.03.25 14:37 I attest to the accuracy and integrity of this document CRM-M-9272-2026 -4- petitioner will join investigation as and when required. She will not tamper with or interfere with investigation and will not leave country without prior permission as provided under Section 482 (2) of BNSS, 2023. 6. Pending misc. application, if any, stands disposed of. (AMARJOT BHATTI) JUDGE 23.03.2026 s " #$ %$& " ' %$& SANDEEP KUMAR 2026.03.25 14:37 I attest to the accuracy and integrity of this document
