ORAL ORDER
The petitioners are before this Court calling in question the registration of a crime in Crime No.604/2023 registered for offences punishable under Sections 498A, 323, 504, 506, 34 of the Indian Penal Code, Sections 3 and 4 of Dowry Prohibition Act, pending before the Addl. Chief Judicial Magistrate, Bengaluru Rural District.
2. Heard Smt. Sunitha M, learned counsel appearing for the petitioners, Smt.Rashmi Patel, learned HCGP appearing for respondent No.1, Sri. Karunashankar K.N, learned counsel appearing for respondent No.2 and have perused the material on record.
3. During the pendency of the proceedings, it transpires that the parties to the lis have settled the dispute amongst themselves and have filed the Memorandum of

Settlement in M.C.No.2208/2024 before the III Additional Principal Judge, Family Court, Bengaluru. They have also filed a compounding application along with joint affidavit before this Court in that regard. The said joint affidavit reads as follows:
JOINT AFFIDAVIT
"1. We, the Petitioners and Respondent No. 2 know the
facts of the case and hence, we are swearing to this affidavit. 2. We state that all disputes and differences between us have been amicably settled before family court in MC No 2208/2024 before III Additional Principal Family Judge, Bangalore by way of settlement before Mediation. wherein, as per the Mediation Agreement the Petitioner No. 1 and Respondent No. 2 have agreed for divorce and the Respondent No. 2 has voluntarily agreed to withdraw all the allegations against the Petitioners. 3. We hereby state that The respondent no.2 had file complaint against the petitioners before Jurisdictional white filed police station in crime No-604/2023 on dated: 19/12/2023 punishable u/s 498 (A), 323, 506, 504, 34 and Under Section 3 and 4 of Dowry Prohibition Act. Upon the said complaint, this Petitioners have filed the present petition for quashing of the said Complaint. Wherein this Hon'ble Court was pleased to grant interim order of stay in favour of Petitioners 2 to 4 on 20-01-2025. stating that
"further proceedings in Crime No. 604/2024 on the file of Additional Chief Judicial Magistrate, Bengaluru Rural District, insofar as the petitioner No.2 to 4 are concerned, are hereby stayed till the next date of hearing". 4. We hereby submit that upon the interim order of stay against Petitioners 2 to 4, the white filed police have filed the charge sheet against the petitioner no.1 alone in CC no 6114/2025 pending before 1st addl Chief Judicial Magistrate Bengaluru Rural. Further the trial court considered the spilt charge sheet and Charges was framed against accused

no.1/ Petitioner No. 1 and presently the stage of the case is evidence on 27-07-2026. 5. We further submit that the Petitioner No. 1 had filed a petition for divorce before III Additional principal family court in MC 2204/2024 wherein, the Petitioner No. 1 and Respondent No. 2 appeared before the family court. Both the parties have voluntarily agreed to dissolve their marriage by a decree of divorce and hence, as per the terms of the Mediation Agreement dated 24-06-2026 under sec 89 of CPC R/w rule 24 of the Karnataka civil procedure (Mediation) rules,
2005. Upon the said Mediation Agreement, the III Additional Principal Family Judge was pleased to consider the Mediation Report and granted a decree for divorce on 24/06/2026. Terms Agreed as per the Mediation Report

It is agreed between the parties that as per the Mediation agreement, The petitioner has agreed to pay a sum of Rs.20,00,000/- (Rupees Twenty Lakhs Only) to the respondent no.2 towards all her claims of permanent alimony as full and final settlement wherein,. The said amount will be paid in the following manner: a. Rs. 10,00,000/- (Rupees Ten Lakhs Only) was paid by way of Demand Draft bearing No.014772, Dated: 24.06.2026, Drawn on Chartered Sahakari Bank Niyamitha, Koramangala Branch Bengaluru was handed over to the Respondent No. 2 before the Family Court on 24-06-2026. b. Rs.5,00,000/- (Rupees Five Lakhs Only) was paid by way of Demand Draft bearing No.006939, Dated: 24.06.2026, drawn on Sreenidhi Souharda Sahakari Bank Niyamith, Marathahalli Branch, Bengaluru, was handed over to the Respondent No. 2 before the Family Court on 24-06-2026 c. Rs.5,00,000/- (Rupees Five Lakhs Only) will be paid by way of Demand Draft bearing No.006940, Dated: 24.06.2026, Drawn on Sreenidhi Souharda Sahakari Bank Niyamith, Marathahalli Branch, Bengaluru was agreed to be paid before this Hon'ble High Court while closing of Crl. P. 2508/2024 in quashing of C.C.6114/2025, pending before I Additional Chief Judicial Magistrate, Bengaluru. - 6 -

d. Both parties state that they have already exchanged their articles and as such they have no claims in this regard. e. The parties herein state that they have no claims over movable or immovable properties belonging to each other either existing or to be acquired or inherited at a later stage in future. f. The parties admit and agree that they have no further claims of whatsoever manner against each other either past, present or future. g. The Respondent No.2 had filed a complaint before the Whitefield Police Station, in Crime No.604/2023 and charge sheet is filed by the said police presently C.C.6114/2025, pending before 1st Additional Chief Judicial Magistrate, Bengaluru.
The respondent has agreed to co-operate in closure of the said complaint either before the I Additional Chief Judicial Magistrate, Bengaluru or before Hon'ble High Court of Karnataka while closing of Crl.P.2508/2024. h. The parties admit and agree that there is no collusion or force, fraud or any undue influence in filing the above petition and entering into this compromise in the aforesaid manner. i. Both the parties state and agree that there are no other cases pending between them, except above mentioned. J. Both the parties agree that they shall delete all the photos and videos available with each other and they shall not post the same in any of the online platform. k. Both parties agreed to withdraw all the allegations made against each other either orally or expressly. l. Both the parties admit that they shall not interfere in the lives of each other in future. m. The settlement has been arrived at voluntarily, without any force, coercion, undue influence, fraud or misrepresentation. 7. Respondent No. 2 has no subsisting grievance or claim against the Petitioners/Appellants in relation to the subject matter of the present criminal proceedings and has no

objection to the offence(s) being compounded in accordance with law. 8. We respectfully request this Hon'ble Court to record the compromise and permit the compounding of the offence(s) under Section 320 of the Code of Criminal Procedure, 1973 or Section 359 of the Bharatiya Nagarik Suraksha Sanhita, 2023 and to pass appropriate consequential orders. 9. We affirm that the statements made herein are true and correct to our knowledge and belief and that nothing material has been concealed."

Learned counsel for the petitioners hands over a demand draft of Rs.5,00,000/- which is acknowledged by the counsel representing the complainant and the complainant who is present before the Court.
5. The parties to the lis are present before the Court and are identified by their respective counsel.
6. In light of the settlement arrived at between the parties as afore-quoted, I pass the following:
