1. The affidavit-of-service filed in Court today is taken on record.
2. The instant application has been filed on 20th January, 2026, inter alia, praying for recalling of the order dismissing the writ petition for default on 13th January, 2026.
3. Having heard the learned advocates appearing for the respective parties and having considered the explanation provided, let the order dated 13th January, 2026 be recalled and the writ petition be restored to its original file and number.
4. Accordingly, the application being CAN 1 of 2026 is allowed. In Re: WPA 1240 of 2025
5. The instant writ petition has been filed complaining illegal construction and the failure on the part of the municipal authorities to take
2 steps in relation to the construction at 16, Alam Mistiri Lane, Pilkhana within P.S. Golabari, ward No. 13, Howrah-711109.
6. The municipality is represented.
7. Having heard the learned advocates appearing for the respective parties, I am of the view that having regard to the complaint made, it would be appropriate to direct the municipal authorities to decide on the petitioner’s complaint by giving opportunity of hearing to the interested parties in accordance with law and to take a decision thereon. It is expected that the decision shall be taken by the municipal authorities as expeditiously as possible preferably within a period of eight weeks from the date of communication of this order.
8. It is made clear that since no affidavit-in- opposition has been called for, the allegations made in the petition, are deemed not to have been admitted by the respondents.
9. With the above observations and directions, the writ petition is disposed of.
