1. The present writ petition has been filed under Article 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the respondents to issue CSD Canteen Smart Card and Scales of Liquor and other consequential benefits to which the petitioner, being the widow of Ex-servicemen, is entitled and to grant minimum family pension admissible to the petitioner.
2. Notice of motion.
3. On asking of the Court, Ms. Bhavana Datta, Senior Panel Counsel, accepts notice on behalf of the respondents and submits that after the constitution of the Armed Force Tribunal, the petitioner has an alternative remedy to file his claim before the Armed Force Tribunal under Section 3(o) of the Armed Force Tribunal Act, 2007.
4. In view of the above, learned counsel for the petitioner seeks permission to withdraw the present writ petition with liberty to the petitioner to avail the remedy as is available to him before the Armed Force Tribunal.
