1. The petitioner has filed this petition seeking the following relief:-
“10.1) This Hon'ble Court may kindly be pleased to call for the entire records pertaining to the case of the petitioner from the possession of the respondents for its kind perusal. 10.2) That, this Hon'ble Court may kindly be pleased to issue appropriate writ and direct the respondent authorities
2 to grant increment to the petitioner as per terns and condition of the appointment order. 10.3) Any other relief or relief(s) which this Hon'ble Court may think proper in view of the facts and circumstances of the case may also kindly be granted”
2. Learned counsel appearing for the petitioner would argue that the petitioner was appointed to the post of Lower Division Clerk under respondent No. 2 vide order dated 02.09.1989. He would further submit that the petitioner passed Hindi typing examination on 12.10.1993 and the said qualification was entered into her service book on 12.10.1994. He would also submit that the benefit of annual increment has not been granted to the petitioner after passing of Hindi typing examination. He would contend that the petitioner made a representation before the respondent authorities claiming grant of annual increment, but till date the same has not been decided; thus, he would pray that the petitioner may be permitted to make a fresh representation before respondent authorities and in turn the authorities concerned may be directed to decide the same in an objective manner. 3.
On the other hand, learned State counsel would submit that the petitioner was required to pass the Hindi typing examination within a period of two years from the date of her appointment, but the petitioner could not acquire said qualification, therefore, the benefit of advance increment has not been extended by the department to the petitioner; thus, the petition deserves to be dismissed. 4. I have heard learned counsel for the parties and perused the documents. 5. The appointment order stipulates that the petitioner is required to acquire the qualification of the Hindi Typing Examination within a period of two years from the date of appointment, thereafter the petitioner would become eligible for the benefit of advance increment. 3 It is further stipulated in the order of appointment that the petitioner would be entitled to the benefit of the advance increment from the date of passing the Hindi Typing Examination. 6. A plain reading of the aforesaid condition contained in the appointment order of the petitioner would make it clear that the petitioner becomes entitled to the benefit of the annual/advance increment from the date of passing the Hindi Typing Examination. As petitioner has already acquired the requisite qualification, therefore, she is entitled for benefit of the increment from the date of passing the Hindi Typing Examination. 7. Having considered the facts discussed above, the petitioner is permitted to make a representation before respondent No. 2 and the authority concerned is directed to consider the same in accordance with law. 8.
