And In the matter of : Tahiruddin Mondal ……Petitioner. Mr. Sekhar Kumar Basu, Sr. Adv, Mr. Anisur Rahman Mr. Sayan Mukherjee .....for the Petitioner. Mr. Md. Golam Nure Imrohi Mr. Partha Pratim Sinha ......for the De-facto complainant. Mr. Bhaskar Seth ……for the State. Learned senior advocate appearing for the petitioner submits that petitioner is in custody for more than ten months and other accused persons have been granted bail. Learned advocate appearing for the State has produced a report. Report reflects that also the case was registered in the year 2020 but the charges were framed on 05.04.2023, till date no witness has been examined. State has taken up a plea that petitioner has been absconding for five years. However, there has been no progress in the case. Having considered that petitioner is in custody for ten months, accordingly, on stringent conditions petitioner is released on bail. As such, prayer for bail of the petitioner is allowed. 2 Accordingly, the petitioner, namely, Tahiruddin Mondal shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Chief Judicial Magistrate, Behrampore, Murshidabad. If on bail, the petitioner shall be physically present on each and every date before the learned Court and shall not leave the jurisdiction of district of Murshidabad without prior permission of the learned Court. Additionally, after released on bail petitioner shall once in a week meet with the Officer-in-Charge of Jalangi Police Station till further orders of this Court. If there is any violation of the aforesaid conditions, the learned trial Court would cancel the bail without further reference to this Court. With the aforesaid observations, CRM (M) 1673 of 2026 is allowed. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
