Affidavits of service filed in Court today are taken on record. 2. The petitioner’s prayer seeking higher scale of pay on account of enhancing her educational qualification was filed before the District Inspector of Schools, Secondary Education, South 24 Parganas in July, 2024. 3. Specific case of the petitioner is that the petitioner joined the course prior to joining the post in question and, accordingly, the question of obtaining prior permission does not arise at all. 4. Learned advocate representing the petitioner submits that the issue in question is covered by the decision passed by the Hon’ble Division Bench of this Court on 11th February, 2021 in MAT 825 of 2020 in the matter of Md. Adeel Uz Zaman Vs. The State of West Bengal & Ors. 5. As it appears that the prayer of the petitioner is pending consideration before the District Inspector of Schools, Secondary Page 2 Education, South 24 Parganas, accordingly, no useful purpose will be served by keeping the writ petition pending. 6. The instant writ petition is disposed of by directing the District Inspector of Schools, Secondary Education, South 24 Parganas, being the respondent no. 3 herein, to consider and dispose of the prayer made by the petitioner seeking higher scale of pay strictly in accordance with law after giving a reasonable opportunity of hearing to all the necessary parties and in line with the decision passed in the matter of Md. Adeel Uz Zaman (supra). 7. Steps shall be taken in the matter at the earliest but positively within a period of eight weeks from the date of communication of this order. A reasoned order shall be passed and communicated to the petitioner immediately thereafter. 8. If the prayer of the petitioner is allowed, necessary consequential steps shall be taken by the authority without any delay. 9. Learned advocate for the petitioner is directed to forward a copy of the representation along with all supporting documents to the aforesaid respondent at the time of communicating the order of the Court. 10. The writ petition stands disposed of. 11. Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court. 12.
