ORAL ORDER
1. Accused Nos.2 to 6 and 8 in Crime No.49/2026 registered by RMC Yard Police Station, Davanagere, for the offences punishable under Sections 352, 109(1) and 190 of BNS, 2023, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. - 3 -

2. Heard the learned counsel for the parties. 3.
FIR in Crime No.49/2026 was registered by RMC Yard Police Station, Davanagere, for the aforesaid offences against Akash @ Murghan and others based on the first information dated 17.06.2026 received from Praveen M, who is the alleged victim in the present case. Apprehending arrest in the case, petitioners had filed Crl.Misc.No.549/2026, which was rejected on 10.07.2026. Therefore, they are before this Court. 4. Perusal of the material on record would go to show that injured victim and accused persons are known to each other and in the background of some financial dispute, there was a quarrel between them on 15.06.2026. The accused persons thereafter allegedly had assaulted the victim, who had subsequently returned home and on 16.06.2026, he had gone to Hospital and had taken treatment. Thereafter, on 17.06.2026, he had approached the police. Therefore, there is a delay of nearly two days in approaching the police in the present case. The very fact that the victim had returned home on the alleged date of incident would indicate that he had not

suffered any grievous injuries in the incident. Petitioners herein do not have any criminal antecedents and have undertaken to cooperate with the police for the purpose of investigation. Accordingly, the following order:-
5. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime No.49/2026 registered by RMC Yard Police Station, Davanagere, for the offences punishable under Sections 352, 109(1) and 190 of BNS, 2023, subject to the following conditions:
1. The Petitioners shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum to the satisfaction of the investigating officer. 2.
Petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioners shall not tamper with the prosecution witnesses and they shall co-operate
