Prabir Halder & ors. Vs. Champak Das
Adv. Dyutiman Banerjee, Adv. Debjit Dutta, …for the applicants/petitioners. Adv. Parashwar Baidya (VC), Adv. Amit Halder, Adv. Ramkrishna Dutta, …for the alleged contemnor.
Affidavit of compliance submitted by the alleged contemnor and exception to the same filed by the applicants/respondents are taken on record. Learned counsel for the alleged contemnor submits that the structure comprising three rooms has been demolished in terms of the undertaking given before this Court. However, learned counsel for the applicants/ respondents submits that only partial demolition has been made. Upon consideration of the submission made on behalf of the parties and documents on record including the photographs appended to both the applications, this Court is of the view that the order under contempt has been substantially complied with. The alleged structure shown in the writ petition appears to have been demolished by the petitioners/opposite parties in terms of the undertaking given by them. The contempt application, therefore, is disposed of. There shall however, be no order as to costs.
2 Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
