Parties are present through their respective Counsels. 2. It is submitted by the learned Counsel for the petitioners that the petitioners have been falsely implicated in this case. He never assaulted the de facto complainant. In view of that he prays for anticipatory bail. 3. On the contrary, learned Counsel on behalf of the State submits that although there are allegations of assault in the materials of Case Diary but there is no injury report. In consideration of the nature of allegations made in the First Information Report and also taking into consideration that no injury report is 2 forthcoming to establish the offence of attempt to murder. 4. Accordingly, I am inclined to allow the petitioners in bail. 5. In the event of arrest, the petitioners, namely, Mangal Makur & Bipadtaran Das shall be released on bail upon furnishing a bond of Rs. 10,000/- each, with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, 1973 corresponding to Section 482 (2) of the BNSS, 2023 and on further conditions that the petitioners shall co-operate with the investigation and shall not threaten or intimidate the witnesses. The petitioners shall meet the I.O. once a week till submission of report in final form. The petitioners shall surrender before the learned jurisdictional Court and pray for bail within four weeks from this date. 6. The application for anticipatory bail being CRM (A) 2491 of 2026, is thus, disposed of. 3 7. Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities. (Md. Shabbar Rashidi, J.)
