Sahu, learned counsel for the petitioner and Mr. Rahul Tamaskar, Government Advocate, appearing for Respondents No. 1 to 4/State. 2.The Petitioner in this Criminal Miscellaneous Petition (CRMP) prays for the following reliefs:- “1. That the Hon'ble Court may kindly be pleased to allow the instant petition under section 528 of BNSS 2023 filed by the petitioner, in the interest of justice. 2. That the Hon'ble Court may kindly be pleased to quash the impugned FIR Crime No. 436/2026 registered on dated 27/08/2026 at police station Utai, District Durg (C.G.) filed under section 296, 3(5), 324(4), 351 (3) of B.N.S. against the petitioner, in the interest of justice. 3. That the Hon'ble Court may kindly be pleased to quash entire investigation and proceeding of FIR NO. 436/2026 registered the offence under section 296, 3(5), 324(4), 351 (3) of B.N.S. against the petitioner, in the interest of justice. 4. That, the Hon'ble Court may kindly grant any other relief in favour of the petitioner, which the Hon'ble Court deemed fit and just in the facts and circumstances of the case, in the interest of justice”. 3.In course of hearing, Mr. Sahu, learned counsel for the petitioner prays for withdrawal of this petition seeking liberty to move the learned Trial Court at the appropriate stage. 4.Mr. Rahul Tamaskar, G.A. does not have any objection to such prayer. 3 5.In view of the above, the CRMP is disposed of as withdrawn with the observation that the petitioner, if so advised, may work out remedy in accordance with the law before the learned Trial Court at the appropriate stage.
