3 THE HONOURABLE SRI JUSTICE MAHESWARA RAO KUNCHEAM CRIMINAL PETITION NO: 4170 of 2026 The Court made the following Order:
Instant Criminal Petition, under Section 528 of the Bharatiya Nagarik Suraksha Sanhitha, 2023, has been filed on behalf of the petitioners herein (A1 to A5), seeking to quash the proceedings in SC No.407 of 2023 on the file of IV Additional District and Sessions Judge, Anantapur for the offences punishable under Sections 307, 498A read with 34 of the Indian Penal Code, 1860 and Sections 3 & 4 of the Dowry Prohibition Act, 1961. 2. Heard Sri P.Siva Rama Krishna, learned counsel for the petitioners and Sri Nelothpal Ganji, learned Assistant Public Prosecutor appearing on behalf of respondent No.1-State. 3.
Learned counsel for the petitioners submits that the petitioners herein are A1 to A5, who are charged for the offences punishable Sections 307, 498A read with 34 of the Indian Penal Code, 1860 and Sections 3 & 4 of the Dowry Prohibition Act, 1961, in SC No.407 of 2023 on the file of IV Additional District and Sessions Judge, Anantapur.

Learned counsel for the petitioners further submits that A1 is the husband of respondent No.2 and A2 to A5 are relatives of petitioner No.1 (A1).
5. During the course of arguments, learned counsel for the petitioners restricted his prayer to the extent of dispensing with the personal appearance of petitioner Nos.2 to 5 herein in the C.C. proceedings before the trial Court and not pressed against petitioner No.1 who is accused No.1.
6. On the other hand, the learned Assistant Public Prosecutor submits that there are specific allegations against the petitioners herein more particularly petitioner No.1 (A1) and as such, he opposed the prayer of the petitioners.
7. However, considering the submissions made by learned counsel for the petitioners as well as learned Public Prosecutor and after perusal of the entire material available on record, as the petitioner Nos.2 to 5 are mere relatives and also considering nature of offences coupled with the old-aged persons i.e., petitioner Nos.2 and 3, the presence of petitioner Nos.2 to 5 (A2 to A5) alone before the IV Additional District and Sessions Judge, Anantapur in SC No.407 of 2023 is dispensed with, except on
5 those dates when the learned Judge feels that their presence is necessary. So far as petitioner No.1 (A1) is concerned, criminal petition is dismissed as withdrawn.
8. Accordingly, the Criminal Petition is disposed of.
Interlocutory applications, if any, pending shall stand closed.
