Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 9 months. Another accused person has been granted bail by this Hon’ble Court and the petitioner is better placed than the other accused who has been granted bail. As such, the petitioner be released on bail on any condition.
Learned advocate for the de facto complainant opposes the prayer for bail and submits that charges have been framed and
2 witness action has commenced.
State has produced the case diary and relied upon the statement of some of the witnesses who have allegedly seen the incident.
Prima facie, I am of the view that the petitioner is not similarly situated as the other accused person, his complicity is completely different. As such, the prayer for bail of the petitioner at this stage in CRM(M)1380 of 2026 is rejected.
