The petitioners by filing this instant writ petition has challenged an inaction on the part of the University of Gour Banga/respondent no. 1 (hereinafter referred to as “the University”) in not releasing the amount of Rs. 10,45,573/- ( Rupees ten lakh forty five thousand five hundred seventy three) only. 2. By a memo dated 10th March, 2017 the Controller of Examination (A/C) & Convener Second Convocation of the said University had issued an order for supply of Silver Casket with Silver Path and Silver Memento in connection with 2nd Convocation of the said University. 3. Mr. Ranajit Chatterjee, learned advocate appearing for the petitioners submits that in terms of the Memo dated 10th March, 2017 his clients supplied those materials 2 and thereafter submitted the bill dated 15th March, 2017. Since the amount was not released by the said University his clients made a representation dated January 13, 2018 to the Vice-Chancellor of the said University. 4. According to Mr. Chatterjee, the said representation is still pending and no payment has been made till date in favour of the petitioners. 5. Learned advocate appearing for the said University submits that the University is ready and willing to consider the representation of the petitioner. 6. In view of the above, this Court directs the respondent no.2 or any authorized officer of the said University to consider the representation dated March 15, 2017 within a period of six weeks from the date of communication of this order. 7. The said University is further directed to extend an opportunity of hearing to the petitioner. 8. The University will decide the issue and will pass a reasoned order. If it is found that the petitioner is entitled to receive the sum mentioned in the bill dated 15th March 2017 or any other sum payable to 3 him, then the same shall be released in his favour within a period of two weeks from date along with interest @ 7% per annum on the said amount from the date of claim of the petitioners till the date of the actual disbursement. 9. The writ petition stands disposed of without any order as to costs. 10. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. . (Arjun Ray Mukherjee, J.)
