ORAL ORDER
The petitioner is before this Court calling in question proceedings in C.C.No.2538/2026, pending before the XXIV Addl. Chief Judicial Magistrate at Bengaluru, for the offences under Sections 85, 115(2), 351(2), 352 of Bharatiya Nyaya Sanhita, 2023 and Section 4 of the Dowry Prohibition Act,
1961.

learned counsel appearing for the petitioner, Smt.Deepthi Alva, learned HCGP appearing for respondent No.1 and have perused the material on record. - 3 -

3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a joint affidavit in that regard. The said joint affidavit reads as follows:
“We, Sandeep R, S/o N Ranganath, Aged about 33 years, R/at No.4 1/1, 2nd A Main road, Govindaraj nagar, Bengaluru city, Karnataka-560040 and Poojitha L W/o Sandeep R, Aged about 33 years, R/at No.19, 1st cross, Gavipuram Extension, Basavanagudi, Bengluru city, Karnataka-560019 do hereby solemnly affirm and state on oath as follows:
1. We state that we are the petitioner and Respondent No.2 in the above case and we are well conversant with the facts and circumstances of the case. Hence, we are swearing to this affidavit. 2. I the respondent No.2/complainant lodged a complaint against the petitioner before the respondent No.1 police station and same was registered in Crime No. 263/2025 for offence punishable under sections 85, 115(2), 351(2), 352 R/w 3(5) of The Baratiya Nyaya Sanhita, 2023 and section 4 of Dowry Prohibition Act 1961 against the petitioner. After investigation, the respondent No.1 police have submitted their charge sheet in C.C. No. 2538/2026 for offence punishable under sections 85, 115(2), 351(2), 352 of The Baratiya Nyaya Sanhita, 2023 and section 4 of Dowry Prohibition Act 1961 and same Pending on the file of Hon'ble XXIV Addl. Chief Judicial Magistrate, at Bengaluru. 3. I, the petitioner had filed a petition for restitution of conjugal rights against the Respondent No.2 in MC No. 804/2026 before the Hon'ble 4th Addl. Prl. Family Court at Bengaluru, subsequently on the advise of elders and well wishers, we the petitioner and respondent No.2 herein settled the matter on 16.07.2026 before the

Karnataka Mediation Centre and the Respondent No.2 has agreed to reside together with the me and to co-operate with the me to close the said Criminal case (C.C.No.2538/2026). 4. We the petitioner and Respondent No.2 submit that due to the advise of elders and well wishers of both the sides now we compromised the matter between us and we have decided to put an end to the litigation.
We don’t want to continue the said case as we both are residing together and leading a happy life. 5. We the Petitioner and Respondent No.2 request this Hon'ble Court be pleased to quash the entire proceedings against petitioner in C.C.No.2538/2026 (Crime No.263/2025) fro offence punishable under sections 85, 115(2), 351(2), 352 of The Bharatiya Nyaya Sanhita, 2023 and section 4 of Dowry Prohibition Act 1961, pending on the file of Hon'ble XXIV Addl. Chief Judicial Magistrate, in the interest of Justice. Hence, we most respectfully pray that this Hon'ble court may be pleased to pass necessary orders as this Hon'ble court deemed fit in the circumstance of the case, in the interest of justice."
4. The parties to the lis are present before the Court and are identified by their respective counsels. 5. In the light of the joint affidavit as quoted supra being filed and offences not being against the State, I deem it appropriate to accept the said joint affidavit and terminate the proceedings against the petitioner in the subject petition. - 5 -

6. For the aforesaid reasons, the following:
ORDER [I] Criminal Petition is disposed.
[II] Proceedings in C.C.No.2538/2026, pending before the XXIV Addl. Chief Judicial Magistrate at Bengaluru, stands quashed qua the petitioner.
