The grievance of the petitioner is that, the Investigating Officer of Bizpur P.S. Case No. 401/2022 dated 28.11.2026 registered for investigation into the offence punishable under Section 448/325/354/379/427/506/34 IPC, was not investigating the case properly. 2. The petitioner, therefore, inter alia, has prayed for a writ of mandamus directing the Police Officers to investigate into the case in the manner as prayed for. 3. A report was called for from the State by this Court. 4. Ms. Suchitra Sinha Chatterjee, learned advocate appearing for the State today files a report before the Court. The said report reveals that after investigation into the alleged complaint, the investigating Officer has already submitted a 2 charge-sheet bearing no. 51/23 dated 06.03.2023 under Section 448/323/354/506/34 IPC before the learned Magistrate. 5. In such view of the matter, the instant writ petition is disposed of with liberty to the petitioner to approach the Court of Learned Judicial Magistrate with appropriate narazi petition in the event, the petitioner/de facto complainant is aggrieved by the investigation into the case. 6. It is, however, clarified that this Court has not expressed any opinion on the investigation conducted by the Investigating Officer of the Court. 7. The writ petition being WPA 777 of 2023 is thus disposed of. There shall be no order as to costs. 8. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Anuj Singh, J.)
