Accused in Crime No.46/2026 registered by Srimangala Police Station, Kodagu District, for the offences punishable under Sections 351(2), 351(3), 109 of BNS, 2023, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.46/2026 was registered by Srimangala Police Station, Kodagu District, for the aforesaid offences against the petitioner herein based on the first information dated 14.05.2026 received from Smt. Bhashika who is the wife of the petitioner. Apprehending arrest in the said case, petitioner herein had filed Crl. Misc. No.5099/2026 before the jurisdictional Sessions Court, which was dismissed on 04.06.2026. Therefore, he is before this Court. 4. First informant who is the wife of the petitioner is present before the Court and submits that she was taken care of in the hospital by her husband and they are now living together. Perusal of the first information would go to show that there is no such mention that prior to the incident in question, petitioner had quarreled with his wife or he had ill-treated her at any point of time. The marriage between the petitioner and the victim in the present case is a love marriage. Though the victim has suffered grievous injuries in the incident in question, considering the aforesaid aspects of the matter, more so the statement of the victim wife who is present before this Court in person, I am of the opinion that petitioner's prayer for grant of anticipatory bail is required to be answered affirmatively. Accordingly, the following order: 5. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime Crime No.46/2026 registered by Srimangala Police Station, Kodagu District, for the offences punishable under Sections 351(2), 351(3), 109 of BNS, 2023, subject to the following conditions: 1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of - 4 - HC-KAR CNR: KAHC010443672026 NC: 2026:KHC:42011 CRL.P No. 9509 of 2026 receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioner shall not tamper with the prosecution witness and he shall co-operate with the police for investigation and appear before them whenever called upon. 4.
