1. Affidavit-of-service filed on behalf of petitioner is taken on record.
2. By presenting this writ petition prayer is made for directing concerned police authorities to restrain respondent no.4 from encroaching upon the land of petitioner.
3. A complaint was lodged on 16th July, 2026 by petitioner and it is submitted taking note of such complaint till date no steps are taken by the concerned police authority.
4. State respondents are represented by Mr. Indrajit Roy Chowdhury, learned Additional Government Pleader who submits that issue involved in this writ petition is civil in nature requiring petitioner to approach appropriate forum.
5. Having considered the submissions made on behalf of respective parties and case made out in this writ petition, it appears that direction is prayed for upon the concerned police authority which would permit petitioner to enjoy peaceful possession over the land in question. Police authority is not the appropriate
2 authority to decide whether petitioner has absolute right over the land in question or not.
6. If petitioner’s right to enjoy peaceful possession over the land is disturbed by respondent no.4, in that event, petitioner needs to approach Civil Court in pursuit of remedy.
7. Hence, present writ petition is not interfered with and same stands dismissed.
8. However, this order shall not preclude petitioner to take steps, in accordance with law.
