1. Heard.
2. Present writ petition is filed by the petitioner for a direction to the learned Family Court to decide the application filed by the petitioner under Section 2 of the Dissolution of Muslim Marriages Act, 1939 (1939 Act) and to expedite the trial of the case .

Learned counsel for the petitioner would submit that petitioner is prosecuting an application filed by her under Section 2 of the 1939 Act, since 16.01.2024 before the learned Principal Judge, Family Court, Raipur but till date, the proceeding of her case is not in considerable progress, and still it is going on. Wp227 327 of 2026 2 Therefore, learned Family Court concerned may be directed to expedite the trial of the case and not to grant any unnecessary adjournment to the parties.
4. Heard learned counsel for the parties, and perused the material annexed with the petition.

From perusal of the order-sheets of the learned Family Court, it transpires that petitioner’s application was filed on 16.01.2024, which was registered on the same day, and notice was issued to the non-applicant, who appeared in the proceeding on 08.10.2024. Thereafter, the matter was adjourned and for counseling of the parties and its report. From 11.03.2024, the matter was adjourned for filing of the reply by the non-applicant but neither the reply has been filed nor any substantive proceeding was taken up in the case.
6. Considering the submissions made by learned counsel for the petitioner and looking to the delay in proceeding, this Court is of the opinion that learned Family Court shall be directed to expedite the trial of the case.
7. Accordingly, learned First Additional Principal Judge, Raipur is directed to expedite the trial of the case-01 of 2024 pending before it filed by the petitioner, to decide the same within six months from the next date fixed before it, after providing proper opportunity of hearing to the parties.
