The present MCC has been filed for extension of time to comply with the order dated 30.06.2026 passed in WPC No.3249 of 2026 (Salikram Sharma vs. State of Chattisgarh and Others). 2. Vide order dated 30.06.2026, when the matter came up for consideration AVINASH SHARMA Digitally signed by AVINASH SHARMA Date: 2026.09.10 17:59:52 +0530 2 before this Court, after hearing both the parties, the Writ Petition was disposed of, with a direction to the concerned Electricity Department/Respondent Nos.2 to 6 herein to restore the electricity supply/connection of Meter installed at hotel premises of the petitioner, subject to the petitioner’s depositing 50% of the fine amount. 3. Pursuant to the direction of this Court, the fine amount of 50% was to be paid on following terms by the petitioner: (i) 25% amount shall be deposited within fifteen (15) days from today(30.06.2026), (ii) the remaining 25% shall be deposited within a period of two (02) months from the date of the first deposit. 4. The Applicant/petitioner herein deposited the first installment of 25% amounting to the tune of Rs. 5,99,634/- on 13.07.2026. 5. Now, the applicant/petitioner by way of this MCC has sought indulgence of this Court with regard to extension of time for depositing of second installment of 25%. 6. Learned counsel for the petitioner submits that the entire business of petitioner was at the verge of closing down after the electricity supply was disconnected as the daily household chores of the petitioner was affected. Hotel Vardan was under construction and was not being run in a full-fledged manner, interiors of all the rooms were not completed and at the same time, the petitioner was also running short of money. In order to earn some money from Hotel Compound, the same was given on rent and out of the rental income of the hotel, the first installment of 25% was paid as directed by the Court. However, on account of financial problems, petitioner is seeking modification of the condition no. (ii) i.e. for depositing the remaining 25% of 3 the fine amount, to the extent that the remaining amount of 25% be deposited within a period of eight months from the date of the first deposit instead of two months. 7. Learned counsel for Respondent Nos.2 to 6 submits that this Court had already took a lenient view by granting two months time to the petitioner to deposit the second installment and now, the petitioner cannot evade his liability on sentimental grounds. 8. Having heard counsel for the parties and upon perusing the record, I am of the view that this Court has already taken a lenient view by granting petitioner two months time to deposit the second installment of 25% and now the petitioner is seeking further 8 months time for the deposit which is not reasonable. However, in the facts and circumstances of the case, two months further time is granted to petitioner from the date of receipt of copy of this order, to deposit the second installment. 9. It is made clear that if the petitioner fails to deposit the second installment within the said period, order dated 30.06.2026 passed in WPC No.3249 of 2026 and this order will lose its efficacy. 10.Accordingly, with the aforesaid observation/direction, this MCC stands disposed of.
