1. In spite of service of notice, none appears on behalf of the defacto complainant. The Affidavit-of-Service filed in Court today be taken on record.
2. Learned Counsel for the petitioner has submitted that the petitioner is in custody for more than 3 years. Only four witnesses have been examined out of fourteen witnesses. For protracting the instance case, the victim was recalled by the prosecution after her cross-examination was over. As the petitioner is a local person and has properties in the locality there is no chance of fleeing away from the course of trial. Considering the period of detention he may be enlarged on bail any condition.

3. Learned Counsel for the State opposes the prayer for bail. He has drawn the attention of this Court to the deposition of the victim and other materials on record.
4. I have gone through the deposition of the victim. She has vividly narrated how the incident occurred. There may be minor anomalies but from an overall assimilation of the materials on record, I have found that the victim has withstood at the time of her cross-examination. Accordingly, I am not inclined to allow the prayer for bail for the petitioner at this stage.
5. The application for bail is, thus, rejected.
6. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.
7. Criminal Section is directed to supply certified copies of this order to the parties, if applied for, upon compliance of all necessary formalities. (Apurba Sinha Ray, J.)
