And In the matter of : Smt. Tulika Majumder & Anr. ……Petitioners. Mr. Nilay Chakraborty,
Mr. Sourav Lohani, ……for the Petitioners. Mr. Janardan Periwal,
Mr. Uday Bhattacharjee,
Ms. Baishali chakrabarty,
……for the State. 1. The petitioners are the parents of the principal accused. The allegation is under Section 108/61(2) of the B.N.S. of 2023, i.e., abetment of suicide. 2. The petitioners say that they have no role to play in the suicide of the victim girl. They have been implicated unnecessarily. They pray for pre-arrest bail. 3. Learned State counsel shows me the case diary. I have seen the statement of the mother of the victim girl recorded under Section 183 of the B.N.S.S. Although there is a passing mention of the present petitioners, no specific role has been attributed to them. 2
4. On an overall assessment of the facts and circumstances of the case, I am of the view that immediate custodial interrogation of the petitioners may not be necessary so long as they co-operate with the investigating officer. 5. Accordingly, in the event of arrest, the petitioners, namely Smt. Tulika Majumder and Gouranga Majumder shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and shall abide by the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 until further orders and on further condition that they shall meet the Investigating Officer of this case as and when called for. 6. In case the petitioners fail to adhere to any of the conditions mentioned in Section 438(2) of the Code of Criminal Procedure, 1973/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, the learned Court below shall be entitled to cancel the anticipatory bail without further reference to this Court. 7. The application for anticipatory bail, being CRM (A) 617 of 2026, stands disposed of.
