Accused No.1 in Crime No.131/2026 registered by Aldur Police Station, Chikkamagaluru, for the offences punishable under Sections 352, 324(4), 109, 115(2) read with Section 3(5) of BNS, 2023, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.131/2026 was registered by Aldur Police Station, Chikkamagaluru, against the petitioner and his mother for the aforesaid offences, based on first information dated 22.06.2026 received from Rajesha, who is the alleged victim in the present case. Apprehending arrest, petitioner had filed Crl.Misc.No.428/2026 before the jurisdictional Sessions Court, which was dismissed on 08.07.2026. Thereafter, he is before this Court. 4. Perusal of the material on record would go to show that there is some monetary transaction between the petitioner and the alleged victim and therefore, there was ill will between - 3 - HC-KAR CNR: KAHC010480542026 NC: 2026:KHC:44634 CRL.P No. 10377 of 2026 them. In respect of the alleged incident that had taken place on 21.06.2026, there is a case and counter case registered in Crime No.131/2026 and Crime No.132/2026 by the very same Police Station. Petitioner is the victim in Crime No.132/2026, in which the first informant in the present case is arraigned as accused No.1 and his mother is arraigned as accused No.2. Wound Certificate of the injured victim in the present case would go to show that he has suffered only simple injuries in the incident in question. Under the circumstances, the following order:- 5. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.131/2026 registered by Aldur Police Station, Chikkamagaluru, for the offences punishable under Sections 352, 324(4), 109, 115(2) read with Section 3(5) of BNS, 2023, subject to the following conditions: 1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall - 4 - HC-KAR CNR: KAHC010480542026 NC: 2026:KHC:44634 CRL.P No. 10377 of 2026 execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioner shall not tamper with the prosecution witnesses and he shall co-operate with the police for investigation and appear before them whenever called upon. 4.
