Sachin Sreenivas learned counsel appearing for the petitioner, Sri. K. Nageshwarappa, learned High Court Government Pleader appearing for respondent No.1, Sri. Srinidhi Athreya, P.M, learned counsel appearing for respondent No.2 and have perused the material on record. 2. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a joint memo along with an affidavit. The joint memo reads as follows: "JOINT MEMO" - 3 - HC-KAR CNR: KAHC010475422026 NC: 2026:KHC:40249 CRL.P No. 10240 of 2026 ." The Petitioner and Respondent No. 2 respectfully submit as under: 1. The Petitioner and Respondent. No.2 have amicably arrived for a settlement with regard to the complaint given by the Respondent No.2 before Respondent No. 1. 2. The Respondent No. 2 had filed the Complaint before the H.S.R. Layout Police Station and the H.S.R. Layout Police registered F.I.R. in Crime No. 552/2023 against the Petitioner and other family members of the Petitioner who are arrayed as Accused No. 1 to 4, for alleged offence punishable under Section 380 of I.P.C., 1860. 3. The H.S.R. Layout Police Station had filed Chargesheet in C.C. No. 24394/2025 only against the Petitioner, for alleged offence punishable under Section 380 of I.P.C., 1860, now pending before The Hon'ble XXXVII A.C.M.M., Bangalore. 4 Petitioner and Respondent No. 2 are husband and wife respectively and their marriage was solemnised on 04/03/2018 at Latur, Maharashtra. The Petitioner's job required him and respondent No. 2 to shift to Bangalore in the month of August, and were living together at Elan Homes, Sector 2, HSR , Bangalore. 5. After the Petitioner left Elan Homes, Sector 2, HSR Layout, Bangalore, to assist his family in Aurangabad on 04/09/2023. The Petitioner was staying with his family in Aurangabad ever since. 6. As the Petitioner was not able to afford the rent, he had to vacate the Elan Homes, Sector 2, HSR Layout, Bangalore, by 30/09/2023 Since the deadline of 30/09/2023 was approaching, the Petitioner got the household belongings at Elan Homes, Sector 2, HSR Layout, Bangalore, by third party logistics service namely Safestorage Technologies And Services Pvt. Ltd. and they had stored it in their warehouse in Bangalore. 7. During the period of the above-mentioned packing and shifting c the belongings from Elan Homes, Sector 2, HSR - 4 - HC-KAR CNR: KAHC010475422026 NC: 2026:KHC:40249 CRL.P No. 10240 of 2026 Layou Bangalore, by the Safestorage Technologies And Services P Ltd., the Petitioner was residing at Aurangabad, Maharashtra, w his family members. 8. The Respondent No. 2 being unaware of the same had f Complaint before the H.S.R. Layout Police Station and the H. Layout Police registered F.I.R. in Crime No. 552/2023 for alle offence punishable under Section 380 of I.P.C., 1860. 9. On 12/03/2024, the Hon'ble XXXVII A.C.M.M., Bangalore pleased to allow the Application under Sections 451 and 4 Cr.P.C., 1973 for release of seized 56 articles Sl.No. 1 to 56 in P.F. No. 12/2024, in favour of the Respondent No. 2. 10. It is now submitted that, after several discussions with mutual consent, the Petitioner and Respondent have mutually agreed to compromise the offences in C.C.No.29494/2026 arising out of Crime No.552/2023 registered by H.S.R. Layout, Police Station, Bengaluru for alleged offence punishable under Sect 380 of I.P.C., 1860, against the Petitioner, now pending on the file of the Hon'ble XXXIX Addi Chief Judicial Magistrate, Bengaluru City. 11. It is submitted that, the Petitioner and Respondent No. 2 de that this Joint Memo is submitted voluntarily, without any influence, coercion, or pressure; and are acting in good faith bring a peaceful conclusion to the subject proceedings. Wherefore, the Petitioner and Respondent No. 2 respondent prays that this Hon'ble Court may be pleased to: i. Quash the Entire proceedings in C.C.No.29494/2026 arising out of Crime No. 552/2023 registered by H.S.R. Layout Police Station, Be for alleged offence punishable under Section 380 of I.P.C against the Petitioner, now pending on the file of the XXXIX Addl Chief Judicial Magistrate, Bengaluru City;" - 5 - HC-KAR CNR: KAHC010475422026 NC: 2026:KHC:40249 CRL.P No. 10240 of 2026 3. In the light of the settlement arrived at between the parties, I deem it appropriate to accept the joint memo and close the proceedings against the petitioner in the subject petition. 4. The crime so registered against this petitioner as well as the charge sheet so filed pursuant to the crime in C.C.No.29494/2026 stands quashed. 5. For the aforesaid reasons, the following: ORDER (i) Criminal Petition is disposed. (ii) Proceedings in C.C.No.29494/2026 pending before the XXXIX Additional Chief Judicial Magistrate at Bangalore , stands quashed qua the petitioner.
