Kausik (Rejected) CRM (NDPS) 1658 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Berhampore Police Station Case No. 2473 of 2025 dated 20.11.2025 under Section 20(b)(ii)(C)/29 of NDPS Act.. And In the matter of : Deep Das & Anr. ……Petitioners. Mr. Subhrajyoti Ghosh Mr. Md. Reazul Hoque ……for the Petitioners. Mr. Gouranga Kumar Das, Ld. APP Mr. Sayan Mukherjee ……for the State. Learned advocate appearing for the petitioners submits that petitioner no. 1 is the driver and petitioner no. 2 is the helper. The total quantum of recovery is 108.4 Kgs. of Ganja. Charge sheet has already been submitted but till date witnesses action has not commenced. Learned advocate for the State opposes the prayer for bail and submits that huge quantity of contraband was seized. One of the accused person is absconding, as such the trial cannot commence. I have taken into account the quantum of seizure and is of the opinion that Section 37 of the NDPS Act is attracted, as such prayer for bail of the petitioner is rejected. 2 Learned Trial Court is directed to exhaust the process of law, split up the trial and progress with the case according to the provisions of law. Thus CRM (NDPS) 1658 of 2026 is dismissed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
