Ms. Vandana Mehra, learned counsel for the petitioners. 2. By the instant petition, the petitioners are praying for the following reliefs:- “i. Issue a writ, order or direction in the nature of mandamus directing the learned Judge, Court of Naib Tehsildar, Nainital to decide the Misc CaseNo.30/2021-2022 (Arising out of Case No. 30/723/189 of 2007-2008) "Girish Lal Sah and Anr V/s Shri Ram Lal and Ors" filed by the petitioner before Court Of Naib Tehsildar, Nainital District Nainital. ii. Issue any other or further writ, order or direction which this Hon'ble Court may deem fit and proper in the circumstances of the case. iii. Award the cost of the petition in favour of the petitioner.” 3. It is argued by the learned counsel for the petitioners that the proceedings which is pending before Naib Tehsildar pertains to mutation preferred in the year, 2021, and, now six months have been passed, but proceedings has yet not been expedited. It is very surprising that the mutation proceeding was filed in the year, 2021 and six years have been passed, and the mutation proceedings 2026:UHC:2887 are summary in nature and if the same is kept for six years, which appears to be great lapse on the part of the Naib Tehsildar. 4. In such view of the matter, the instant petition is disposed of finally with the direction to the Naib Tehsildar to expedite the proceedings of Miscellaneous Case No.30 of 2021-2022 (arising out of Case No.30/723/189 of 2007-2008, “Girish Lal Sah and Another vs. Shri Ram Lal and Others”, positively within one month from the date of the production of certified copy of this order.
